31 U.S. Code § 3727 - Assignments of claims

In subsection (a)(1), the words “or share thereof” and “whether absolute or conditional, and whatever may be the consideration therefor” are omitted as surplus. In clause (2), the word “authorization” is substituted for “powers of attorney, orders, or other authorities” to eliminate unnecessary words.

In subsections (b) and (c), the word “official” is substituted for “officer” for consistency in the revised title and with other titles of the United States Code.

In subsection (b), the words “Except as hereinafter provided” are omitted as unnecessary. The words “read and” are omitted as surplus. The words “to the person acknowledging the same” are omitted as unnecessary. The text of 31:203(1st par. last sentence) is omitted as superseded by 39:410. The words “Notwithstanding any law to the contrary governing the validity of assignments ” and the text of 31:203(last par.) are omitted as unnecessary.

In subsection (c), before clause (1), the words “bank, trust company, or other . . . including any Federal lending agency” are omitted as surplus. The words “of money due or to become due under a contract providing for payments totaling at least $1,000” are substituted for “in any case in which the moneys due or to become due from the United States or from any agency or department thereof, under a contract providing for payments aggregating $1,000 or more” to eliminate unnecessary words. The text of 31:203(2d par. proviso cl. 1) is omitted as executed. In clause (1), the words “in the case of any contract entered into after October 9, 1940 ” are omitted as executed. In clause (2)(A), the words “payable under such contract” are omitted as surplus. In clause (3), the words “true” and “instrument of” are omitted as surplus. The words “department or” are omitted because of the restatement. The words “if any” and “to make payment” are omitted as surplus.

In subsection (d), before clause (1), the words “During a war or national emergency proclaimed by the President or declared by law and ended by proclamation or law” are substituted for “in time of war or national emergency proclaimed by the President (including the national emergency proclaimed December 16, 1950 ) or by Act or joint resolution of the Congress and until such war or national emergency has been terminated in such manner” to eliminate unnecessary words. The words “ Department of Energy (when carrying out duties and powers formerly carried out by the Atomic Energy Commission)” are substituted for “Atomic Energy Commission” (which was reconstituted as the Energy Research and Development Administration by 42:5813 and 5814) because of 42:7151(a) and 7293. The words “other department or . . . of the United States . . . except any such contract under which full payment has been made” and “of any moneys due or to become due under such contract” before “shall not be subject” are omitted as surplus. The words “A payment subsequently due under the contract (even after the war or emergency is ended) shall be paid to the assignee without” are substituted for “and if such provision or one to the same general effect has been at any time heretofore or is hereafter included or inserted in any such contract, payments to be made thereafter to an assignee of any moneys due or to become due under such contract, whether during or after such war or emergency . . . hereafter” to eliminate unnecessary words. The words “of any nature” are omitted as surplus. In clause (1), the words “or any department or agency thereof” are omitted as unnecessary. In clause (2), the words “under any renegotiation statute or under any statutory renegotiation article in the contract” are omitted as surplus.

Subsection (e)(1) is substituted for 31:203(4th par.) to eliminate unnecessary words.

In subsection (e)(2), the words “person receiving an amount under an assignment or allotment” are substituted for “assignees, transferees, or allottees” for clarity and consistency. The words “or to others for them” and “with respect to such assignments , transfers, or allotments or the use of such moneys” are omitted as surplus. The words “person making the assignment or allotment” are substituted for “assignors, transferors, or allotters” for clarity and consistency.

An AOB is intended to make things quicker and easier on policyholders. Since insurance claims can get a little tricky, it can be challenging and time-consuming to navigate, especially if you've never had to file a claim in the past.

For a car claim, signing an AOB means you just drop off your ride to get repaired and pick it up when it's done. The vendor then sorts out the details of getting paid by your insurance. Pretty straightforward, right?

But using an AOB doesn't mean "risk free." This is why you should thoroughly read and understand any document put in front of you during a claim.

AOB challenges for insurance policyholders

While an AOB authorizes the third party to act, one problem with removing yourself from the claim process is that now you're not part of the claim process. Not such a big deal if your repairs get done on time and to your satisfaction. But what if you have questions about your repairs? What if there's an unexpected delay?

When you sign an AOB for your insurance policy, the repair shop or contractor becomes the policy beneficiary for the claim — not you. As a result, you may lose transparency and control over your claim. Your insurance company may even be limited in what it can do to help.

This underlines why it's so important to know and understand what you are signing. It can impact what rights you have during a claim.

Let's say you had a leak in your home and begin work with a contractor to repair the damage and manage the claim on your behalf. Maybe the work stalled or you were presented with explanations of the scope of work. Something may seem fishy and you want to get to a resolution. Signing an AOB may limit what your insurance company can tell you or do to support you.

Unfortunately, AOBs have been associated with fraud and increased litigation in some states. The aggregate impact of inflated claims costs and lawsuits ultimately may impact policyholders with increased premiums or poor claims experiences.

What should you do when filing a claim?

First and foremost, contact your insurance company. They can provide next steps for your situation. Take pictures of your home or vehicle and document what happened as best as you are able. If you go direct to a vendor or contractor first, read and understand any documents that require your signature.

Second, know who you're doing business with. Find reputable vendors or seek direction from your insurance company if there is a preferred vendor to use. AOBs are legally binding, and they can give vendors power to exaggerate the scope of your claim, with or without your knowledge. So, it's important to work with a vendor you can trust.

Always keep an eye out for AOB clauses on any document from a third-party vendor to make sure to weigh out the pros and cons. Don't unknowingly sign away your rights or policy benefits.

The research considers the category of reasonable balance of interests in the context of civil relations. The authors of the article highlight the need to restrict permissibility as a method of civil regulation aimed at protecting the rights and interests of the weaker party in some legal relations. A reasonable balance of interests is ensured by laws and agreements, whose conditions become the subject of a judicial dispute in the absence of a mandatory rule. The authors have analyzed judicial acts conditioned by the need to maintain a reasonable balance of interests. As a result, they have determined that the first condition for applying the fair balance principle is the equivalence of counter-performance in the absence of both excessive benefits and excessive losses for the parties. The second condition is the party-related division in some civil relations. The authors have concluded that the risks of negative consequences should not be borne only by the weaker party if the latter could not reasonably foresee the consequences upon concluding the relevant agreement. Methods. The study is based on the comparative analysis of the Russian scientific doctrine and judicial practice. The main approach to the analysis of the legal tools in question is the method of system analysis. In addition, the authors used the structural-functional method and general scientific methods of cognition. The study aims at determining the principle of a reasonable balance of interests in civil law, its essence, necessity and expediency in the system of law enforcement. The authors aim to define conditions for applying legal norms to achieve a reasonable balance of interests among all parties in disputed legal relations. Results. The study results let the authors claim that the risks of negative consequences should not be borne only by the weaker party if it could not reasonably foresee such consequences upon concluding the agreement and the imbalance of interests among parties in civil-legal relations is caused by the violation by one or another party of the principles of fair practice and reasonableness . Although a reasonable balance of interests is a counterweight to the principles of contractual freedom and free will, courts should apply it to ensure the right of justice.

The classic insurance company work model with gamma-distribution of claim amount is considered. It is supposed that the company applies a dividend barrier strategy. The form of the expected discounted dividends accumulated until the ruin and the expected discounted deficit at the ruin are found. We deal with the optimal barriers which maximize either the dividends amount or shareholders profit. The barrier optimization is illustrated by some examples.

My Vote: My Responsibility, Opinion, Future and Freedom

It’s not just my vote. It is my responsibility. 

The right to vote was fought for. Blood, sweat, and tears drenched. The heros before me sacrificing more than I can fathom. Fighting for what they deserved. Not worrying about the effects of their life, but considering how it would benefit generations to come. Knowing it was unfair, knowing it was their right, knowing they needed change. The shame that would come to their faces today. Seeing all their dedication and sacrifice be wasted by not using our right. So go vote!

It’s an ability to show my opinion.

My vote is my voice! Make my voice heard. I want my opinion to matter. I want people to know my side of the story. Assumptions are dangerous. If I do not reveal my perspective, others will do it for me. That is something I can not live with. Something I won’t live with. Something you should not live with either. So go vote!

It’s a way to shape my future and the future of the world.

My world is dying. I am not talking about the nature of the Earth. Yet, about the nature of people. My world is diseased from corruption. It has seen a turn in human nature. I no longer worry about how I will get food to eat. But worry about how it will get stolen. My world is being taken, and I mean to save it. I want to shape my own future. Not allow it to be carved by the more powerful. I want my vote to transform my world into the best it can be. Then it can be the best for everyone. So go vote!

It’s a way to show my freedom.

I am free. We are all free. America, the land of the free, yet I see most as caged in. Like a lion in a circus, it is being held back from it’s true potential. I am responsible for how others view me, my country, and my freedom. Don’t forget it is your responsibility too. You need to vote!

How Britain's taste for tea may have been a life saver

Tea has been many things in its time – a global commodity, a comforting beverage, and even, in the eyes of some Bostonians 250 years ago this week, a symbol of oppressive politics. But one role you might not have attributed to tea is that of a life-saving health intervention.

In a recent paper in the Review of Statistics and Economics , economist Francisca Antman of the University of Colorado, Boulder, makes a convincing case that the explosion of tea as an everyman's drink in late 1700s England saved many lives. This would not have been because of any antioxidants or other substances inherent to the lauded leaf.

Instead, the simple practice of boiling water for tea, in an era before people understood that illness could be caused by water-borne pathogens, may have been enough to keep many from an early grave.

English demographics from this era have long contained a puzzle for historians. Between 1761 and 1834, the annual death rate declined substantially, from 28 to 25 per 1,000 people . But at the same time, wages do not seem to have risen much and standards of living arguably did not increase. In fact, with the rise of the industrial revolution, more and more people were crowding into towns whose sanitation left much to be desired. "I would say it's not a settled debate," says Antman.

The idea that tea might be the missing link here, thanks to the need to boil water for a proper brew, had been floated by historians in the past . Boiling water kills bacteria that cause diarrheal diseases like dysentery, which was often called "flux" or "bloody flux" in death records.

"With people coming into cities to work, you would expect, given the level of sanitation they have, that the big killer is water," says Antman. But it remained a somewhat fuzzy idea, interesting in theory but difficult to prove.

Antman developed a way to test it, using detailed geographical information about more than 400 parishes across England. There is a simple assumption at the heart of her study: more water sources in an area likely means cleaner water. If one source was contaminated, the inhabitants of a parish could go to another. What's more, if people were closer to the sources of rivers – something Antman infers from parishes' elevation – that water was likely safer than in parishes further downstream.

By assigning parishes an inferred level of water quality, Antman could see whether areas with worse water quality saw a bigger decline in mortality than those with good water.

In terms of testing this hypothesis, the key date is 1785, the moment when tea suddenly became affordable for the vast majority of Britons. There were many things already to recommend tea as a drink of the masses: you could make a satisfying brew with just a small amount of leaves, the leaves could be reused for multiple pots, and tea was potentially cheaper than beer, which was rendered expensive both by the complex process required to make it and by a tax on malt.

But when 1784's Tea and Windows Act went into effect, the tax on tea went from 119% to just 12.5% and tea consumption exploded. By the end of the 18th Century, even very poor peasants were having tea twice a day , tea historian Alan Macfarlane writes.

To see if this change correlated with decreased mortality, Antman compared death rates before and after this watershed moment. For this she drew on the remarkable work of demographers E A Wrigley and R S Schofield , who in the mid-20th Century collected parish records from all over England spanning 1541 to 1871, including deaths.

As expected, Antman found that death rates declined in both parishes with good water and those with bad – but there was a significant difference in the size of the decline. Parishes with bad water saw death rates drop 18% more than those with good water.

What's more, she looked to see whether deaths in London from waterborne diseases like "bloody flux", and deaths from airborne pathogens like tuberculosis, or "consumption", were linked to levels of tea imports. Indeed, flux deaths declined when tea imports went up, while TB deaths remained about the time.

She also checked to see whether deaths in children – not known, in this age or any other, for being major consumers of tea – changed in London with tea imports, and found that there did not seem to be a decline in deaths of those ages two to five.

Interestingly, there was a slight decline in infant deaths, perhaps reflecting the fact that if tea-drinking parents had less diarrheal disease, their very young children might have been protected a bit as well – though Antman points out there is no way to know for sure.

For Antman, who primarily works on issues related to developing nations, this natural experiment in England all those years ago reflects a fundamental truth: sometimes people's existing behaviours can make more of a difference to their health than an explicit intervention might.

Building more privies, developing better plumbing and sewage systems, and teaching people to keep drinking water and wastewater scrupulously separate all might have extended people's lives, had such interventions been widely understood and available.

But with relatively little change to their habits, merely an increase in a behavior they already enjoyed, people seem to have protected themselves. All part of the pleasure of a simple cup of tea.

32.803 Policies.

(a) Any assignment of claims that has been made under the Act to any type of financing institution listed in 32.802 (b) may thereafter be further assigned and reassigned to any such institution if the conditions in 32.802 (d) and (e) continue to be met.

(b) A contract may prohibit the assignment of claims if the agency determines the prohibition to be in the Government’s interest.

(c) Under a requirements or indefinite quantity type contract that authorizes ordering and payment by multiple Government activities, amounts due for individual orders for $1,000 or more may be assigned.

(d) Any contract of a designated agency (see FAR 32.801 ), except a contract under which full payment has been made, may include a no-setoff commitment only when a determination of need is made by the head of the agency , in accordance with the Presidential delegation of authority dated October 3,1995, and after such determination has been published in the Federal Register. The Presidential delegation makes such determinations of need subject to further guidance issued by the Office of Federal Procurement Policy. The following guidance has been provided:

Use of the no-setoff provision may be appropriate to facilitate the national defense ; in the event of a national emergency or natural disaster; or when the use of the no-setoff provision may facilitate private financing of contract performance. However, in the event an offeror is significantly indebted to the United States , the contracting officer should consider whether the inclusion of the no-setoff commitment in a particular contract is in the best interests of the United States . In such an event, the contracting officer should consult with the Government officer(s) responsible for collecting the debt(s).

(e) When an assigned contract does not include a no-setoff commitment , the Government may apply against payments to the assignee any liability of the contractor to the Government arising independently of the assigned contract if the liability existed at the time notice of the assignment was received even though that liability had not yet matured so as to be due and payable.
