Paris, 23 February 2024 - The fifth Plenary of the FATF under the Presidency of T. Raja Kumar of Singapore concluded today. Delegates from the FATF’s Global Network of over 200 jurisdictions and observers from international organisations participated in three days of discussions on key money laundering, terrorism financing and proliferation financing issues at the FATF headquarters in Paris.

Among the key outcomes of the Plenary is a new risk-based guidance for the implementation of Recommendation 25 on the beneficial ownership and transparency of legal arrangements. This completes the FATF’s body of work to enhance transparency of beneficial ownership globally and prevent criminals and terrorists from hiding their activities and funds behind complex corporate structures and legal arrangements such as trusts. The FATF will continue its outreach to ensure effective implementation of the revised Standards.

The Plenary also agreed to release for public consultation, a range of options for potential changes to Recommendation 16 and its Interpretive Note on wire transfers. The proposed revisions seek to adapt FATF Standards to the changes in payment systems' business models and messaging standards and ensure that they remain technology-neutral.

In preparation for the next round of mutual evaluations, the Plenary finalised modifications to its assessment methodology to reflect the recent revisions to the FATF Standards to protect non-profit organisations from potential abuse for terrorist financing.

The FATF identified jurisdictions with materially important virtual asset activity, to support them in implementing the FATF’s requirements to supervise and regulate this activity.

The FATF updated the statements identifying high-risk and other monitored jurisdictions and removed four countries from its increased monitoring list following successful on-site visits.

The Plenary agreed on the appointment of a new President of the FATF (2024-2026).

The FATF issued a statement on the Russian Federation.

Compliance with the FATF Standards

Jurisdictions under increased monitoring .

Jurisdictions under increased monitoring are actively working with the FATF to address the strategic deficiencies in their regimes to counter money laundering, terrorist financing and proliferation financing. When the FATF places a jurisdiction under increased monitoring, it means the country has committed to implement an Action Plan to resolve swiftly the identified strategic deficiencies within agreed timeframes. At this Plenary, the FATF added Kenya and Namibia to the list of jurisdictions subject to increased monitoring.

Jurisdictions no Longer under Increased Monitoring - Barbados, Gibraltar, Uganda and the United Arab Emirates

The FATF plenary congratulated Barbados, Gibraltar, Uganda and the United Arab Emirates for their significant progress in addressing the strategic AML/CFT deficiencies previously identified during their mutual evaluations. These jurisdictions had committed to implement an Action Plan to resolve swiftly the identified strategic deficiencies within agreed timeframes. These countries will no longer be subject to the FATF’s increased monitoring process.

This comes after a successful on-site visit to each of these countries. Each country will work with the FATF-Style Regional Body, of which it is a member, to continue strengthening their AML/CFT/CPF regimes.

Jurisdictions subject to a call for action

FATF identifies countries or jurisdictions with serious strategic deficiencies to counter money laundering, terrorist financing, and proliferation financing. These jurisdictions are subject to a call for action to protect the international financial system. No new countries/jurisdictions were added to this list.

Strategic Initiatives

Setting the strategic priorities for 2024-2026.

In preparation for the next biennium, delegates discussed the specific areas of focus for the FATF to deliver on its mandate to prevent criminals, the corrupt and terrorists from abusing the international financial system and strengthen the foundations for sustainable and more inclusive economic development.

The FATF’s Strategic Priorities will be presented to FATF Ministers at the upcoming FATF Ministerial meeting in April.

Increasing Beneficial Ownership Transparency Globally

Fatf risk-based guidance - recommendation 25 on beneficial ownership and transparency of legal arrangements .

Following the February 2023 revisions to FATF Recommendation 25 on Beneficial ownership and transparency of legal arrangements, the FATF has updated its risk-based guidance for this Recommendation. The guidance complements the existing guidance on Recommendation 24 on legal persons and aims to help stakeholders from the public and private sectors that are involved in trusts or similar legal arrangements to assess and mitigate money laundering and terrorist financing risks.

The finalised guidance reflects input from public consultations on the draft guidance following the October Plenary.  The FATF extensively engaged with the private sector and other stakeholders on this initiative. The updated guidance completes a comprehensive body of work aimed at improving transparency of beneficial ownership globally. FATF’s strengthened standards and guidance in this area will help identify the corrupt, sanctions evaders, money launderers and tax evaders who hide or launder their criminal property or activities in shell companies or other complex structures as well as trusts or other legal arrangements.  

The FATF will assess countries’ implementation of these requirements during its upcoming round of mutual evaluations.

The guidance will be published at the end of February.  

Leveraging Digital Transformation: Virtual Assets 

Many countries have yet to fully implement the FATF’s revised Recommendation 15. Given the inherently borderless nature of virtual asset activity, this lack of implementation leaves significant loopholes globally, that criminals and terrorists exploit.

In February 2023, the FATF Plenary agreed on a roadmap to strengthen implementation of the FATF Standards on virtual assets and virtual asset service providers.  The FATF conducted a stocktake of current levels of implementation across the global network.

The Plenary agreed to publish an overview of the steps that FATF and FSRB member jurisdictions with the most materially important virtual asset activity, based on trading volume and user base, have taken to regulate and supervise virtual asset service providers (VASPs). The purposes of this exercise are to enable the FATF network to support these jurisdictions in regulating and supervising VASPs for AML/CFT purposes and to encourage jurisdictions to fully implement Recommendation 15.

Payment Transparency

The FATF has worked on proposed amendments to Recommendation 16, to reflect the rapid development of cross-border payment systems, and changes to industry standards in particular ISO20022.

These revisions aim to help make cross-border payments faster, cheaper, more transparent and more inclusive whilst ensuring AML/CFT compliance, and ensure that FATF Recommendation 16 remains technology-neutral.

The Plenary agreed to release the proposed revisions for public consultation.

Protecting Non-Profit Organisations from abuse for Terrorist Financing

At its October 2023 Plenary, the FATF agreed on amendments to Recommendation 8 that aim to protect non-profit organisations (NPOs) from potential terrorist financing abuse through the effective implementation of risk-based measures. The FATF also updated its best practices to reflect the amendments to Recommendation 8 and to help countries, the non-profit sector and financial institutions understand how best to protect relevant NPOs from abuse for terrorist financing, without unduly disrupting or discouraging legitimate NPO activities.

The FATF has now agreed on changes to its assessment methodology for the next round of mutual evaluations, which clarify the existing obligations to apply risk-based measures to protect NPOs that are most vulnerable to potential terrorist financing abuse and prevent the unintended consequences of the incorrect application of the FATF’s requirements. 

FATF Presidency 2024-2026

This week, the Plenary decided to appoint Ms Elisa de Anda Madrazo of Mexico as the next President of the FATF, for a fixed two-year term.

FATF members took this decision following a comprehensive process which included consultations with all delegations. Ms de Anda Madrazo, who was FATF Vice President from 1 July 2020 to 30 June 2023, will take up duties on 1 July 2024, the day after the two-year Presidency of Mr. T. Raja Kumar concludes.

FACT SHEET: President   Biden Issues Executive Order to Protect Americans’ Sensitive Personal   Data

Today, President Biden will issue an Executive Order to protect Americans’ sensitive personal data from exploitation by countries of concern. The Executive Order, which marks the most significant executive action any President has ever taken to protect Americans’ data security, authorizes the Attorney General to prevent the large-scale transfer of Americans’ personal data to countries of concern and provides safeguards around other activities that can give those countries access to Americans’ sensitive data.

The President’s Executive Order focuses on Americans’ most personal and sensitive information, including genomic data, biometric data, personal health data, geolocation data, financial data, and certain kinds of personally identifiable information. Bad actors can use this data to track Americans (including military service members), pry into their personal lives, and pass that data on to other data brokers and foreign intelligence services. This data can enable intrusive surveillance, scams, blackmail, and other violations of privacy.

Companies are collecting more of Americans’ data than ever before, and it is often legally sold and resold through data brokers. Commercial data brokers and other companies can sell this data to countries of concern, or entities controlled by those countries, and it can land in the hands of foreign intelligence services, militaries, or companies controlled by foreign governments.

The sale of Americans’ data raises significant privacy, counterintelligence, blackmail risks and other national security risks—especially for those in the military or national security community.  Countries of concern can also access Americans’ sensitive personal data to collect information on activists, academics, journalists, dissidents, political figures, and members of non-governmental organizations and marginalized communities to intimidate opponents of countries of concern, curb dissent, and limit Americans’ freedom of expression and other civil liberties. 

To protect Americans’ sensitive personal data, President Biden is directing:

  • The Department of Justice to issue regulations that establish clear protections for Americans’ sensitive personal data from access and exploitation by countries of concern. These protections will extend to genomic data, biometric data, personal health data, geolocation data, financial data, and certain kinds of personal identifiers. They will prevent the large-scale transfer of that data to countries of concern—which have a track record of collecting and misusing data on Americans.
  • The Department of Justice to issue regulations that establish greater protection of sensitive government-related data, including geolocation information on sensitive government sites and information about military members.
  • The Departments of Justice and Homeland Security to work together to set high security standards to prevent access by countries of concern to Americans’ data through other commercial means, such as data available via investment, vendor, and employment relationships.
  • The Departments of Health and Human Services, Defense, and Veterans Affairs to help ensure that Federal grants, contracts, and awards are not used to facilitate access to Americans’ sensitive health data by countries of concern, including via companies located in the United States.
  • The Committee for the Assessment of Foreign Participation in the United States Telecommunications Services Sector (often called “Team Telecom”) to consider the threats to Americans’ sensitive personal data in its reviews of submarine cable licenses.
  • That these activities do not stop the flow of information necessary for financial services activities or impose measures aimed at a broader decoupling of the substantial consumer, economic, scientific, and trade relationships that the United States has with other countries.

These actions not only align with the U.S.’ longstanding support for the trusted free flow of data, but also are consistent with U.S.’ commitment to an open Internet with strong and effective protections for individuals’ privacy and measures to preserve governments’ abilities to enforce laws and advance policies in the public interest. The Administration will continue its engagements with stakeholders, including technology companies and advocates for privacy, safety, competition, labor, and human rights, to move forward in a way that appropriately balances all these objectives.

The President has encouraged the Consumer Financial Protection Bureau to consider taking steps, consistent with CFPB’s existing legal authorities, to protect Americans from data brokers that are illegally assembling and selling extremely sensitive data, including that of U.S. military personnel.

Additionally, President Biden continues to urge Congress to do its part and pass comprehensive bipartisan privacy legislation, especially to protect the safety of our children.

As a social psychologist, couples counselor and relationship expert, I've spent over 20 years working with thousands of individuals and couples.

The unfortunate reality is that many people don't know how to build and nurture loving relationships, and one area that's easily overlooked when things get busy is operations. In order to remedy this, I always encourage a weekly operations check-in to discuss upcoming admin duties. 

I've found that it's usually these daily tasks, and each partner's perception of fairness, that ultimately causes a lot of conflict. So if you only have time for one check-in each week, make it this one. I would even go so far as to say that it's non-negotiable.

Cover any and all upcoming tasks 

Once a week, sit down and talk about all the actual tasks that have to be done in order for the household to run smoothly in the coming week. Some of my couples call this the "Team Meeting." If you have children who are old enough to participate, include them, too.

No task is too small to go on this list. Grocery shopping, meal planning, meal prep, cleanup, laundry, drop-offs and pickups, plant watering, car maintenance, bill-paying — all of it has to be addressed. 

Be realistic about your list and talk about the resources you each need. One week one of you might have more bandwidth, and the other less. Make sure to leave some room for things that erupt during the week unexpectedly as well. For instance, who will stay home if a child gets sick?

Over time, a lot of things become automatic and some tasks only have to be discussed when there's a change. 

Bring up your pain points and get creative

This weekly meeting is also a good time to bring up things you'd prefer not to do. I call these your "pain points." If you really dislike washing dishes or making lunches, see if you can negotiate a different arrangement.

If neither of you wants to or can be on top of a task, maybe it's time to get creative or delegate it. For example, hire a dog walker or arrange a carpool for your child once a week while you go grocery shopping. 

Make a list you can refer back to and adjust

Create a list that's visible to you both, like a shared online calendar with different color coding.

When my husband Pejman and I have our meetings, we add things in our calendars according to a color code that, among other things, indicates whether tasks are hard to move (i.e., they can only be canceled or interrupted if something very urgent comes up) or flexible (i.e., they can be moved around if need be). 

You might end up finishing tasks from each other's list to make life easier for them because your half-day meeting on Wednesday got canceled — one reason why a shared list where tasks and updates are visible to both of you can be so helpful.

Be honest and transparent 

Communicate your capacities and abilities as soon as possible to your partner. They may be disappointed or annoyed, but it will be far worse if you drop the ball completely without a heads up.

Annoyance and disappointment can be rectified, but if you're constantly dropping the ball, your partner will see you as unreliable, and the trust between you will be shaken. That's much harder to repair.
